About the Presentation
All employment laws are interconnected. One decision can trigger several laws, and multiple liabilities. All decisions require interaction of all management levels, and can impose organizational and personal liability on executives, supervisors, board members and HR. All must understand the issues and work together.
This program provides the opportunity for HR professionals to bring executives and supervisors so that all understand the legal and practical issues, and the importance of how to work together to legally and practically address employment issues.
Topics that will be discussed:
- Personal Liability - Are You in the Crosshairs? Executives and Supervisor’s Personal Liability in Employment Cases. Beware and be aware! Personal liability means that legal damages are collected from the individual’s personal bank account, retirement fund and/or sale of personal property (car, home, collectibles, etc.) In a growing number of cases, plaintiffs are naming both the employer as well as the individual(s) who were “in charge.” In these cases the court may award damages against both the organization and the individual manager. This program covers the danger areas and preventative practices.
- Liability for Employee Off-the-Clock Behaviors - Off the Clock But Still on the Hook . Off the clock is not off the hook for liability. What is "off the clock" for wage and hours and FMLA purposes? Why can customers or the public sue the company and the managers personally, for employees’ non-paid-time acts? Are you liable for what a worker did on vacation? Can after-work happy hour be a liability? Can an employer fire workers for “private” activities off the job (blogs, chat rooms, social activities)? Where are the lines between invasion of employee privacy, employer responsibility, and liability to the public? Learn the danger areas and have policies and practices to protect your company and yourself.
- FMLA for Supervisors - FMLA Basics for Supervisors and Executives. HR may handle the complex regulations, forms, and intricate details of FMLA. However, managers are most directly affected, and executives may be personally liable for FMLA violations. Managers and executives need to have a fundamental understanding of FMLA (and other legal leave rules for companies under 50 employees), and how to coordinate with HR to assure fair treatment of employees and proper compliance with the laws. Practical pointers on what to do and what not to do.
About the Presenter
Bob Gregg, Chair of the Labor & Employment Practice Group, Boardman & Clark Law Firm in Madison, Wisconsin, has been involved in Employment Relations for more than 30 years. He also litigates employment cases, representing employers in employment contracts, discrimination cases, FLSA, FMLA and all other areas of employment law. His main emphasis is helping employers achieve enhanced productivity, creating positive work environments, and resolving employment problems before they generate lawsuits. He has designed the workplace policies of numerous employers. Bob has conducted over 3,000 seminars throughout the United States and authored numerous articles on practical employment issues. Bob is a member of the Society for Human Resource Management, the National Speakers Association, is a National Faculty Member of the American Association for Access, Equity and Diversity and served on the Board of Directors for the Department of Defense Equal Opportunity Management Institute Foundation.
Using humor and anecdotes drawn from personal experience, he simplifies and illustrates even the most complex employment issues in layman’s terms. His seminars bring a positive, practical, “hand-on” approach to help employers succeed, identify problems, avoid litigation, and implement good employment practices.
